Privacy

These privacy policies (“Privacy Policies”) contain the manner in which SkillShadow, LLC or any of its affiliates operating the www.SkillShadow.com website including offering e-fly® interviews (collectively “SkillShadow”) collects, stores, uses, shares and protects your (“User”) information. SkillShadow strives to provide a safe and secure environment for Users. These Privacy Policies constitute a legally binding agreement between you as the User and SkillShadow. These Privacy Policies may be updated occasionally by posting such revised Privacy Policies on the SkillShadow website. You as the User agree that such posting constitutes reasonable notice of such changes. Continued use of SkillShadow’s website after notice shall constitute the User’s acceptance of such revised Privacy Policies. If at any time you the User do not accept SkillShadow’s Privacy Policies, then you must discontinue accessing, viewing, and using the SkillShadow website. These Privacy Policies are incorporated into SkillShadow’s Terms and Conditions (“T&C”) and the provisions hereof are incorporated therein. Any use of SkillShadow shall constitute User’s acceptance of the then-current T&C and Privacy Policies.

As required by SkillShadow’s T&C, Users must be at least 13 years of age or older, and Users under the age of 18 (or the age of majority in your jurisdiction) must utilize the site with the permission and supervision of a parent, legal guardian, or other responsible adult. It is SkillShadow’s policy and intent to not collect information from children under the age of 13, or under the age of 18 without consent of a parent, legal guardian, or other responsible adult. Presently, Users under 16 years of age will not be able to participate in e-fly® interviews.

As required by SkillShadow’s T&C, Users must provide SkillShadow with a valid e-mail address, update such e-mail address as necessary in the User’s Account, and immediately notify SkillShadow of any unauthorized use of their Account. Users are responsible for establishing and maintaining the confidentiality of their User Account. 

As indicated in SkillShadow’s T&C, SkillShadow reserves the right to inactivate or delete a User’s Account after a significant period of dormancy. Although deleted, a User’s information may have previously been accessed and stored by SkillShadow or third parties. SkillShadow and such third parties are under no obligation to delete such archival records. 

When a User registers with SkillShadow either as an employer or as a jobseeker, the User’s e-mail address will not be disclosed to third party marketing companies. 

As a key component of SkillShadow’s unique process, jobseeker Users will not be contacted directly by employers with whom the jobseeker has been matched unless the jobseeker gives them permission. When there is a match between a jobseeker User and an employer User, a jobseeker’s name and e-mail address will only be shown to a potential employer after the jobseeker has specifically chosen to indicate interest in that employer’s position. Once granted access by a jobseeker’s indication of interest, an employer may review information in that jobseeker’s skills profile(s), such as a resume, website link, or other sensitive, personal, or non-public information provided in the jobseeker’s profile(s) whether keyed-in, selected, attached, or uploaded by such jobseeker. Such personal information that a jobseeker has chosen to provide is at his or her sole discretion. SkillShadow does not utilize the registration related personal information it collects (i.e., a User’s name and e-mail address) in order to perform a match.

An employer User’s entry, including all information submitted whether keyed-in, selected, attached, or uploaded by such employer, will be available for public display under the heading Jobs.

Depending upon the way Users interact with SkillShadow and submit information to the system, under certain conditions of use third parties are able to view a User’s personal information and to contact you. While SkillShadow takes measures to safeguard Users’ information from unauthorized access or inappropriate use by third parties, SkillShadow is not responsible for third parties’ use of personal, sensitive, and/or non-public information Users make available on SkillShadow. Personal, sensitive, and/or non-public information that Users make available on SkillShadow may be accessed, used and stored by third parties, including those in countries that may not have legislation that guarantees adequate protection of personal information as defined by the User’s country of residence.

The type of information SkillShadow may collect about Users is as follows:

Personal Information: A User’s name and e-mail address, plus a User’s Skype name for purposes of facilitating e-fly® interviews. Users may choose to voluntarily input additional personal information. Voluntarily input personal information may be publicly available.

Demographic information: A User’s status as an employer or jobseeker. Aggregate information may be publicized.

Qualifications Information: SkillShadow collects and aggregates data about jobseeker Users’ education and experience. Aggregate information may be publicized.

Preferences Information: Although SkillShadow does not collect address information, SkillShadow collects and aggregates data about Users’ preferences for language, job country, location, industry, specific area, position, optional keywords, education and experience desired by employers, and pay desired. Aggregate information may be publicized.

System Information: The type of operating system and computer any User is using may be indicated to us by the User’s browser. In addition, the SkillShadow website uses cookies. The website will attempt to set a temporary "session cookie" that lasts the length of a User’s visit to the site. This cookie allows SkillShadow to collect information on what is viewed on the site, but not personally identifiable information about the User, unless the User is logged in. Users have the right to accept or decline cookies by adjusting their browser settings. SkillShadow may record and publicize information about aggregate usage of the website and e-fly® interviews.

e-fly® Information: SkillShadow collects a User’s Skype name for the purpose of facilitating e-fly® interviews. When Users request or accept an e-fly® interview invitation, Users consent to both the SkillShadow Privacy Policies and the Skype Privacy Policy (http://www.skype.com/intl/en-us/legal/privacy/general/). 

Inferential Information: SkillShadow may make inferences about Users based upon data provided in Users’ Personal, Demographic, Qualifications, Preferences, System, or e-fly® Information, and User input such as choice of language, which may be used to personalize the experience and advertisements for the User.

SkillShadow may display advertising from third parties of a general or targeted nature while Users are visiting SkillShadow. SkillShadow has no control over, and is not responsible for, the content or practices of such third party advertisers. Advertising may be targeted based upon Demographic, Qualifications, Preferences, System, or Inferential information and therefore may or may not be of benefit to Users. 

In a transaction in which SkillShadow’s business is acquired in whole or in part by a third party, SkillShadow reserves the right to include the transfer of Users’ Personal, Demographic, Qualifications, Preferences, System, e-fly®, and Inferential Information in such acquisition.

Aggregated non-personal data from our databases may be compiled and shared with Users and made public. 

SkillShadow may disclose a User’s information subject to a valid request from a properly authorized entity if legally required to do so. SkillShadow is a Texas LLC and is subject to the laws of the United States.

These Privacy Policies are effective as of February 7, 2015.

Terms & Conditions

 

These Terms and Conditions (“T&C”) constitute a binding agreement between you as a registered user (“User”) and SkillShadow, LLC or any of its affiliates operating the website www.SkillShadow.com including offering e-fly® interviews (collectively “SkillShadow”). These T&C may be updated at any time and from time to time by posting such revised T&C on the SkillShadow website. Upon interaction with SkillShadow, the User is bound by the T&C currently posted and in effect. Users are responsible for acquainting themselves with the currently effective T&C. SkillShadow’s Privacy Policies are incorporated herein. If at any time you do not accept SkillShadow’s T&C or Privacy Policies then do not use the services or access the website of SkillShadow. Any use of SkillShadow shall constitute User’s acceptance of the then-current T&C and Privacy Policies.

Property

The concept and proprietary content (Property) of SkillShadow (such as computer code, design, text, images, formats, processes, logos, brands, tag lines, icons, images, graphics, software, video files, audio files, databases, programming, buttons, templates, search engines, matching algorithms, intellectual property, and patents) are hereby claimed and protected to the fullest extent under copyright, trademark, and other laws. Unauthorized use of SkillShadow’s property is strictly prohibited.

Interference

Interference or attempted interference with the security, registration, servers, network, website host, databases, search engines, matching engines, or other Users of SkillShadow by means of reverse engineering, duplication, forgery, data mining, viruses, Trojans, worms, spam, overloading, flooding, mail bombing, crashing, or hacking SkillShadow is strictly prohibited.

Use

Users shall not knowingly submit any false, misleading, deceptive, or inaccurate representations. Users shall not key in, upload, attach, embed, link to, or otherwise cause to be submitted to SkillShadow any unlawful, illegal, deceitful, vulgar, harassing, inflammatory, provoking, offensive, annoying, embarrassing, inappropriate, disruptive, defamatory, obscene, pornographic, indecent, sexually explicit, suggestive, discriminatory, racist, sexist, condescending, abusive, hateful, menacing, libelous, malicious, nefarious, violent, objectionable or threatening content of any kind. Users shall not submit content that is instructional as to illegal activities. In its sole discretion, SkillShadow may remove User content that damages or discredits its brand or public image, contradicts its values, or causes SkillShadow to lose favor with other Users, investors, owners, suppliers and service providers, or creates liability for SkillShadow. Users are solely responsible for their use of SkillShadow and content submitted and any consequences arising from such use or content. SkillShadow disclaims any obligation to censor User content and further disclaims liability for failure to do so.  

Users shall not use SkillShadow to solicit, peddle, rent, sell, promote, or advertise products or services or competitors of SkillShadow. 

SkillShadow claims no ownership, responsibility, or control over User submitted content. By submitting content on SkillShadow, Users grant SkillShadow a worldwide, non-exclusive, royalty-free license to reproduce, adapt, distribute, and publish such content on SkillShadow. 

If a User voluntarily submits comments, suggestions, feedback, creative ideas, concepts, drawings, or inventions to SkillShadow regarding SkillShadow’s services or website, such submission becomes the property of SkillShadow for SkillShadow’s exclusive and unrestricted use and shall not be subject to confidentiality on the part of SkillShadow nor shall such voluntary submission entitle such User or other person to compensation. 

SkillShadow does not vet or verify User supplied content. SkillShadow does not represent or warrant the truthfulness, accuracy, or completeness of User content. The Users of www.skillshadow.com are solely and individually responsible for compliance with applicable local, state, national, and international laws, conventions, and regulations, including but not limited to fair hiring practices, non-discrimination, equal employment opportunity, employment eligibility requirements, User privacy and all other laws applicable in their respective locales.

SkillShadow reserves the right to refuse or withdraw access to any User at its sole discretion. 

Liability

Users access SkillShadow at their own risk. A User assumes all risks of dealing with other Users with whom the User comes in contact as a result of use of SkillShadow. Users are urged to use caution and common sense as to their personal and financial safety. SkillShadow may contain links to third party websites. These are provided solely as a convenience to Users and not as an endorsement of the content. Users access third party websites at their own risk.

Users who are residents of California waive California Civil Code Section 1542, which says “A general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor at the time of executing this release, which if known by him or her must have materially affected his or her settlement with the debtor.” 

SkillShadow does not represent or warrant that the services provided by SkillShadow will fulfill their intended purpose or are fit for any purpose, including but not limited to availability and freedom from interruption of service (including e-fly® interviews); therefore, SkillShadow, its suppliers and service providers, shall in no event be liable for any damages whatsoever, including incidental or consequential, resulting from use of SkillShadow or reliance thereon.

Regardless of the cause of action, SkillShadow’s maximum liability arising out of or in connection with a User’s use of SkillShadow shall not exceed the lesser of $100.00 USD or the amount actually collected from User.

Users agree to defend, indemnify, and hold harmless SkillShadow, its subsidiaries, parents, and affiliates, and their respective owners, operators, officers, directors, partners, employees, and agents, from and against any claims, actions, or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from User submitted content or any other use of SkillShadow or breach of these T&C. SkillShadow shall use reasonable effort to promptly notify User of any such suit, proceeding, claim or action.  

SkillShadow may remedy violations of the T&C through termination of a User’s Account, but is not liable for failure to do so. SkillShadow may pursue and will cooperate with law enforcement in prosecution of Users for civil and/or criminal violations of these T&C. 

Failure on the part of SkillShadow to enforce any provision of these T&C shall not constitute waiver of such provision and shall not affect SkillShadow’s rights to enforce such provision at a future time.

These T&C are governed by the laws of the state of Texas.  

Unauthorized Use

Users must be at least 13 years of age or older, and Users under the age of 18 (or the age of majority in your jurisdiction) must utilize the site with the permission and supervision of a parent, legal guardian, or other responsible adult. Users under the age of 16 may not participate in e-fly® interviews.

Users must provide SkillShadow with a valid e-mail address, update such e-mail address as necessary in the User’s Account, and immediately notify SkillShadow of any unauthorized use of their Account. 

SkillShadow reserves the right to inactivate or delete a User’s Account after a significant period of dormancy.

SkillShadow must be used only by individuals seeking employment or by employers seeking employees.

SkillShadow may not be used in countries subject to economic sanctions of the United States or by users who are nationals or residents of Cuba, North Korea, Iraq, Iran, Libya, or Syria. SkillShadow may not be used in any other country or by any other individual subject to prohibition by the United States or any of its agencies or departments. SkillShadow makes no claim that SkillShadow may be lawfully accessed or used outside of the United States.

e-fly® Interviews

Users who participate in e-fly® interviews are further subject to the terms and conditions of Skype (http://www.skype.com) as they may be updated from time to time.
